An Agege Customary Court in Lagos has sentenced a 42-year-old woman to 14 days imprisonment for contempt of court without an option of fine.
Falola, an interior decorator, filed the suit seeking the dissolution of his union with his wife on the grounds that she was quarrelsome.
In its judgment, the court had directed the estranged husband to pay a monthly upkeep allowance of N10,000 through the court to the only child of the marriage.
The court also ordered Falola to pay the sum of N120,000 to his wife, Modupe, to secure an apartment.
Earlier, Falola, 58, had told the court that if the marriage was not dissolved, it could lead to his untimely death.
"My wife has not given me peace since she moved into my house six years ago; she fights almost everybody around me.
"I lost my peace since she moved into my house; so, I want the court to dissolve the union.
"Throughout the time we were together, she kept me in the dark on what her income per month was. If I asked her how much her salary was, she would say I should not bother," he said.
Modupe, who lives at No 2, Moji Adenigba Close, New Oko Oba, Lagos, however, pleaded with the court not to dissolve the marriage, saying, "I still love my husband."
The court president, Mr. Emmanuel Sokunle, said Modupe Ajayi had refused to vacate her ex-husband's house seven months after judgment was given.
"Mr. Falola, your ex-husband gave you, Modupe, the money we ordered him to give you in the judgment and you were asked to vacate his house.
"The court also sent a notification to you to vacate the premises of Falola, you refused even after he gave you the money to rent a house.
"We served you another notification two months later but you didn't answer. It is seven months that the judgment was given and you are still in the same house," Sokunle said.
He said a bench warrant was issued and Modupe was summoned to the court.
"You are hereby sentenced to 14 days imprisonment for contempt. I believe if you come back, you must have learnt one or two lessons," the magistrate declared.
He adjourned the case till May 30, 2013 for further hearing.
