Court fixes ruling for Jan 8 in Daniel's case

An Ogun State High Court sitting in Isabo, Abeokuta, on Friday fixed ruling for Jan. 8, 2013 in an application brought by former Gov. Gbenga Daniel, seeking the quashing of the first 13 counts of the 38 counts preferred against him by the Economic and Financial Crimes Commission.

Daniel is facing charges of stealing, fraudulent conversion of public lands and diversion of public funds, among others.

His lead counsel, Prof. Taiwo Osipitan (SAN), had in October requested the court to strike out counts 1 to 13, which he said had to do with alleged illegal land acquisition.

But praying the court to strike out the 13 charges on Friday, another counsel, Tayo Oyetibo (SAN), argued that the continued hearing of counts 1to 13 would amount to injustice.

He said a commission of enquiry set up by the state government had already found the accused (Daniel) guilty and that the findings had been made public.

He, therefore, averred that the action of the government was a deviation from established legal norms, urging the court to strike out counts 1to 13, stay proceedings on them or adjourn proceedings on them in the interest of fair hearing and acceptable legal norms.
