Umeh loses again at appeal court

FRESH attempts by the embattled national chairman of All Progressives Grand Alliance (APGA), Mr. Victor Umeh, to lift the ex-parte order barring him from parading himself as such by an Enugu High Court presided over by the state's Chief Judge, Justice Innocent Umezulike, suffered a big setback yesterday at the Court of Appeal, Enugu Division.

Ruling on an appeal filed by Umeh for the lifting of the injunction and stay of ruling on the substantive case, the Court of Appeal presided over by Justice Abdulkadir Jega stated that it was at a loss on what the applicant (Umeh) wanted to achieve through his two motions, since, according to him, "the applications on their face value are incompetent".

Earlier before adjourning the matter to November 20, 2012, Jega had invited Umeh to explain whether he was abandoning his first motion dealing with the lifting of the ex-parte order in preference to the second appeal against the ruling by Umezulike on the substantive case for which judgment has been reserved by the High Court.

Umeh, through his counsel, Mr. Patrick Ikwueto (SAN) declined and sought for a brief adjournment to harmonise his positions, even as counsel for Jude Okuli, Mr. Chudi Obieze; insisted that it was improper in law to preempt the judgment of a court since the window for appeal remains open to the parties.

Short of throwing out the ambiguous applications, Jega, assisted by Justice Shodipe Lakolu; asked the embattled chairman to "go back to your drawing board, then come back and tell the court what you think about the two applications".

Umezulike had on July 25, 2012; imposed an interim order restraining Umeh from convening any meeting or parading himself as the national chairman of APGA pending the determination of a suit filed by Jude Okuli, a member of the party in Enugu, complaining that the actions of the embattled chairman, who he said was occupying office illegally, were capable of causing anarchy and chaos in the party.

But dissatisfied by that ruling, Umeh went to the Appeal Court pleading that the ex-parte order be quashed with an additional prayer that judgment on the substantive matter at the High Court be halted owing to the fact that he had earlier expressed reservations over Umezulike's handling of the matter.

Speaking to journalists after the ruling, counsel to the respondent, Okuli; Chudi Obieze said it was not proper to blackmail the court or stay course of justice outside the law. He added that Umeh's preemptive prayers against a judgment that has not been delivered by a court of competent jurisdiction would not succeed.

Murder of two musicians in Warri sparks protest

ANGER is brewing in Warri, Delta State over the shooting to death of two musicians, Tony Omoro and a fellow band man, Fidelis Amani, by soldiers from the 3rd Battalion, Effurun, also in Delta over allegations that they threatened to abduct a hotelier and businessman, Chief Jonathan Governor.

The duo were allegedly lured to the hotel owned by Chief Governor, who had reported to the police that they threatened to kill him if he did not pay a certain sum of money. They were arrested and later killed by soldiers last Tuesday.

Yesterday, the family members of the deceased and members of the Niger Delta Salvation Front led by Alhaji Mujahid Asari Dokubo, protested the alleged extra judicial murder of the musicians, saying that soldiers of the 3rd Battalion killed the two musicians ignorantly.

Lt Col. Ifeanyi Out, Commander of the 3rd Battalion while confirming the death of the two men, alleged that they were killed while escaping with a bag containing ransom money.

But the solicitors to the family of the deceased, Festus Keyamo Chambers, yesterday alleged illegality in the murder, saying they were neither kidnappers nor assassins as alleged by the military authorities in Warri, but were set up and murdered.

According to Barrister Matthew Omonade of Keyamo Chambers: "We were shocked to read a sponsored story saying that Tony Omoro was a kidnapper and an assassin and that he was killed as he tried to escape to escape with ransom money. Let the military authorities tell us where in Ekpan that the incident took place. We have reliable information that Tony Omoro is a renowned musician and not a kidnapper.

"We are writing petition to the appropriate agencies to ensure that justice is done. We have had several cases where innocent people have been extra judicially murdered.

"There was an allegation of an attempt to kidnap, there was no kidnap incident. The police should have been called in to investigate the matter and not to lure the suspects to the hotel of the chief who reported the matter, where they were taken away and killed. It was a calculated attempt to murder Tony Omoro and Fidelis Amani," Omonade said.

He demanded that the soldiers who were used as instruments in the killing of the two men should be prosecuted along with Chief  Governor, who was never abducted.

Women no longer joke with their husbands again, so ladies beware.

The incident, which can be apparently described as a nude wrestling show, forced parents to cover the faces of children in Lusaka Zambia, Missisi Compound with their palms as the events that unfolded before them were not fit for minors.

Police confirmed the case which happened last Wednesday. The assailant, Shamiso Marovero has since been fined $10 for indecently assaulting Portia Madhuku who was only left with torn undergarments after the melee. When the source news crew visited the scene, a sobbing Madhuku was at loss of words to explain the beatings she encountered at the hands of Marovero and eight others.
"They were nine of them and they approached me when I was selling my clothes. They beat me up, stripped me naked and left me with tattered under garments," she said. When asked if she had indeed snatched Marovero's husband and was sleeping with him, Madhuku denied ever bedding him. She said her relationship to Marovero's husband was a business one with no strings attached.

"I am not in love with her husband. I only came to know him when he sold some jackets to me on credit. I bought two jackets and paid for them and I never saw him again. However, Marovero, was singing from a different hymn book. She accused Madhuku of being in love with the father of her children saying the affair began in June this year.

"I discovered the affair in June but I kept quiet. I couldn't confront her because I did not have enough evidence. However, the truth came out when one of her best friends told me everything. I confronted her hence the fracas," she said. Marovero, however, refused ever beating Madhuku saying she only stripped naked "I did not beat her, why should I?"she boasted.Madhuku pleaded with The Weekender not to publish the story saying it would break her fragile relationship with her husband, which she is trying to sort out.

"Please I don't want you to publish the story because it will badly affect my relationship with my husband, which is on the rocks," she said. Manicaland spokes person Inspector Enock Chishiri said Marovero and two of her accomplices who partook in stripping Madhuku have since paid $10 admission of guilty fines. He urged members of the public to desist using violent means to settle scores.

The Attorney General and Commissioner for Justice of Lagos state,Mr. Ade Ipaye, has vowed that Lagos State Government will prosecute all persons allegedly involved in the vandalization of some of its property during the October 24, 2012 protest by commercial motorcycle operators.
Ipaye said this in his office on Wednesday in an interview with the News Agency of Nigeria.
He said he could not comprehend why some commercial motorcycle operators will destroy BRT buses and other government assets while protesting their restriction from 475 roads in the state.
He said "I cannot tell you the number. I just got reports that arrests were made, some have already been taken to court.
"But I can assure you that we are determined to ensure that those people face proper legal procedure that should follow such a very, very criminal vandalism of public assets."
Responding to the allegations that some policemen and other law enforcement agents arresting commercial motorcyclists who were plying side streets,he said, law enforcement agents were working with a list compiled by the Lagos State Government indicating the prohibited areas.
"The issue whether you are where you should be or not, must be determined by reference to the list.
"And when you are in doubt, you should consult that list. It has been variously publicised, printed by the ministry of information.
"When you are in doubt and you are an operator, infact, I expect all the unions in that industry to have that list and to circulate it among their members,"he added.
The Attorney General noted that restriction of their operation is only on 475 roads out of over 9,000 roads in Lagos State, adding that there were other available employment opportunities in the state.
"There are various job opportunities out there already existing or being created. Government is spending billions on infrastructure development, people are engaged there.
"So, to say that you must keep what is not desirable or has been determined to be not desirable for us, just to keep some people in employment, I think it's
a logic I cannot understand".
"If we all don't respect the laws and we do whatever we can in the name of trying to feed our families, if we take it that for survival you can do anything, then we will not have a civilised society," he added.
Ipaye concluded that the suit against the government over the restriction was already being heard by a court of competent jurisdiction which will soon deliver its judgement

That's good news as she was said to have returned to Nigeria this morning. News filtered in today that Oyo First Lady, Mrs Florence Ajumobi was arrested yesterday by London's Metropolitan police in the UK for being in possession of £400, 000 (100 million). But the London MET has denied that any such arrest took place. They said there's no information on the alleged arrest in their police database

Follow @9jaLife While they are two different people, and are now on two different labels, watching this video, and listening to this song, I couldn’t help but wonder if this was created specifically for D’Prince, or was merely a track that was a leftover from the days of D’Banj. Set in what seems to be a lounge and an expensive crib, and directed by Derek Pike this video features D’Prince talking about ‘Taking Banana’, backed by a bunch of women oozing sexuality. BTW If you don’t know what ‘Take Banana’ means, you’re probably too young, when you grow up you’ll figure it out. For the rest of us, the imagery is more than sufficient to tell the whole story. Personally I like the track, but I’m wondering if turning D’Prince into a clone of a (still alive and musically active) D’Banj is really the way to go… D’Prince also released a cover for his new album ‘Frenzy’, I’m sure the ladies will be more than pleased, for I doubt any artist has gone that low since D’Angelo released his ‘Untitled’ ‘How Does It Feel’ video in 2000… The three singles that came with the album: Goodybags, Call police, and RealG can also be downloaded here: http://www.dprinceishere.com/ Follow @9jaLife

What a tragedy, it's better to listen to warnings o, if only..............
 
She was a paragon of beauty not long ago. She now wears a new but frightening look. But when 30 year-old Prophetess Folashade Esther Ogunseye of the Celestial Church Genesis Model Parish Agbado, Ogun state went into trance for seven days sometime in July this year, she warned her church members not to celebrate the feat for her.

But they would have none of that as they insisted on rolling out the drums. So on the fateful day, they prepared food and practically dragged her to the church where they danced round her to celebrate the spiritual feat.
In the midst of the celebration, one of the church workers called Elijah allegedly sprayed perfume known in celestial parlance as Ona La on the dancers without taking cognizance of lighted candles which some of them were holding. Alas the perfume caught fire and Sade was set ablaze along with three other members who had joined in the celebration. A pastor in the church who had come to rescue them was also affected by the fire.

However, Sade was the worst-hit as she suffered severe burns. So the once delectable Sade has been turned to a monster of sort.

It took a while, but I think I have accepted that my figure will be one of the things people talk about . I would hate it to be the main and only thing that people dwell on however," Beat Fm's on air personality, Tolulope Oniru popularly called Toolz says.

Before now, Tools was always uncomfortable with her curvy shape but after a few months of her incursion in airwave business, she has seen it as a tool that will make her brand name, Toolz rise to the desired status.

No doubt, a singular picture of the dark skinned presenter is all it takes to drive traffic and generate a stream of comments which sometimes runs into hundreds on blogs and online media. While some of the feedbacks are vile, others are simply enamoured.
