CONFLIT IMMOBILIER : Cinq procès à venir pour identifier les vrais propriétaires de 355 arpents de terrains

La justice mauricienne est actuellement appelée à trancher dans une série de cinq procès en revendication de propriétés immobilières — les uns très étroitement liés aux autres — impliquant un peu plus de 355 arpents de terre situés dans le nord du pays.
À la lecture des multiples affidavits et contre-affidavits jurés à ce jour devant la Cour suprême relatifs à ces procès, on peut d'ores et déjà prévoir que ceux-ci retiendront certainement l'attention dans les prochains jours/mois non-seulement en raison de l'immensité des biens immobiliers concernés, mais surtout par le nombre de parties qui y seront engagées et ses retombées sociales sur des dizaines de familles qui, en ce moment, occupent lesdits terrains. En sus de nombreuses familles qui se proclament des héritiers ayant droits sur ces terrains, sont parties prenantes des procès deux sociétés d'investissements étrangères (Sandy Row et Lloyd Bowmaker), des promoteurs immobiliers locaux (dont Société Domaine Le Mapou, Société Blue Coast et A & A Marketing), des avoués, des notaires, des arpenteurs et le conseil de district de Pamplemousses-Rivière du Rempart.

Un rapport d'arpentage soutient que rien n'a été vendu !
À l'origine de la série de procès se trouvent les revendications — exprimées séparément — de plusieurs familles ou branches de familles qui se disent toutes les descendants/héritiers d'un monsieur Jean Faoulez. Celui-ci — comme d'ailleurs clairement établi par le rapport de la Commission Justice et Vérité — a été propriétaire de conséquentes portions de terrains dans les régions de Melville/Grand-Gaube, dans le district de Rivière-du-Rempart, dont (i) une superficie de 120 arpents selon le casier hypothécaire TV 06 n°69 ; (ii) 157 arpents 23 perches selon le TV 05 n°178 et ; (iii) 75 arpents selon le TV 12 n°71.
D'après un récent rapport d'arpentage commandité par une des parties et réalisé par un professionnel très respecté dans le domaine — rapport soutenu par des recherches effectuées auprès du Bureau du Conservateur des Hypothèques ainsi qu'aux Archives nationales — quelque cinq portions de terrains de ce monsieur Faoulez n'ont jamais été vendues ni par lui ni par ses héritiers depuis 1812 à ce jour. Or, à la suite d'une opération dite arpentage contradictoire dans le jargon immobilier, menée par le même professionnel, il a été observé que plusieurs de larges pans des terrains sont occupés par des particuliers. Des sociétés y ont également construit des appartements. La Cour suprême, apprenons-nous, sera sollicitée pour vérifier si ces particuliers sont devenus acquéreurs à travers des prescriptions en bonne et due forme. Ou s'il ont acheté auprès de prescripteurs ou des récupérateurs de terrains notoirement connus et dénoncés notamment par la Commission Justice et Vérité. Ou, encore, s'ils n'auraient pas été leurrés par des sociétés de promotion dont certaines font l'objet d'enquêtes de l'ICAC et de la police.
Parmi ceux-là qui soutiennent descendre directement de Jean Faoulez et qui se plaignent d'avoir été illégalement dépossédés de leurs héritages se retrouvent les familles Michel, Zamudio, Selway et deux membres portant encore le nom de Faoulez. Certaines de ces familles sont représentées par Raymonde Bissett, descendante du côté des Michel. La plupart des membres de ces familles mentionnées vivent maintenant en Australie et en Angleterre. Mais il y a également la famille Rochecouste-Collet qui, elle aussi, entend faire valoir ses prétentions. Les Rochecouste-Collet affirment que les terrains revendiqués par les Faoulez ne leur appartiendraient plus parce qu'ils auraient été cédés par Jean Faoulez à un certain Jean Caillaud à travers un testament holographique en date du 12 octobre 1821. Les Bissett, Michel et autres ont l'intention de remettre en cause la validité de ce testament. Ce qui, déjà, promet d'être un procès à l'intérieur des procès déjà nombreux…

Un ordre interlocutoire  en faveur des Rochecouste-Collet
À ce stade, suite à des demandes formulées en chambre, la Cour suprême a rendu plusieurs arrêts interlocutoires favorables à la fois aux familles Rochecouste-Collet et aux Michel, Bissett et autres. Concernant les membres de la famille Rochecouste-Collet, dans un premier temps un juge leur avait accordé un ordre interlocutoire interdisant à la Société Domaine Le Mapou et à la Société Blue Coast de disposer de trois portions de terrains à Rivière-du-Rempart faisant l'objet de litige en attendant un jugement final. Les Rochecouste-Collet avaient soutenu dans leur plainte en chambre que deux membres de la famille Faoulez, Hughes et May Victoria s'étaient fait «frauduleusement et faussement» passés pour les seuls héritiers de Jean Faoulez et avaient, à l'insu de tous, incorporé tous les terrains concernés dans les sociétés Domaine Le Mapou et Blue Coast sous formes «d'apports en société».
Société Domaine Le Mapou et Blue Coast ont fait appel contre l'ordre interlocutoire mais, le 21 février dernier, elles ont été déboutées par le chef juge suppléant d'alors, Keshoe Parsad Matadeen, et le juge Sahid Bhaukaurally. Ces juges ont refusé de croire les deux sociétés à l'effet que les Rochecouste-Collet se sont trop longtemps endormis sur ce qu'elles affirment être leurs droits — soit de 1821 et 2008 — pour pouvoir maintenant venir les revendiquer. Au contraire, ont souligné les deux juges, Société Domaine Le Mapou et Blue Coast ont été incorporées (c'est-à-dire qu'elles ont obtenu leurs reconnaissances légales) le 25 juillet 2007. Or, réagissant très rapidement, les Rochecouste-Collet ont entamé des recherches pour déposer une plainte en justice une année après. Dans de telles circonstances, selon les deux juges, Société Domaine Le Mapou et Blue Coast ne peuvent pas «sérieusement» dire que les Rochecouste-Collet ont fait preuve de retard ou de négligence dans la défense de ce qu'ils estiment être leurs intérêts.
De son côté, Raymonde Bissett a obtenu jusqu'ici du juge Eddy Balancy le droit d'intervenir dans trois des cinq procès dans lesquels des sociétés et des particuliers se poursuivent mutuellement au civil. En attendant que ces procès soient pris sur le fond, Me. Jean Marie Leclézio, l'avoué de Raymonde Bissett, a fait publier un long avis légal dans la presse cette semaine, notamment pour informer la Société Dumaine Le Mapou qu'elle devrait s'abstenir de «commettre tout acte susceptible de modifier la propriété d'un des terrains avant que la Cour suprême ne prenne une décision ayant trait à ces terrains.» De façon indirecte, l'avoué Leclézio aurait ainsi mis en garde les membres du public contre les risques que comporterait toute acquisition d'une des terres revendiqué.
